As things stand now you can download Solaris 10.9 (not opensolaris) for free from oracle if you have an oracle account. Is it really offered for free?

If you read the license agreement on the free downloads, you will note it states “only for the purpose of developing, testing, prototyping and demonstrating your applications, and not for any other purpose.” Commercial production use requires paying Oracle for it.
